“While I fully understand the
need for heightened security in the wake of the 7/7 and 7/21 attacks
on London’s mass transit system, it is of the utmost importance
that NYPD officers receive strict instructions not to single out
individuals for search on the basis of race, ethnicity, or religious
garb. Officers who disobey this order should be severely disciplined.
“To help ensure that those being
searched aren't being racially profiled, the NYPD must keep strict
records on the ethnicity and race of everyone searched. So-called
random searches are unnerving: if they are not conducted on a
strictly random basis, they will go against the basic premise
of our Bill of Right. Furthermore, if New Yorkers do not trust
police officers to respect their civil liberties, the NYPD’s
ability to keep the public safe will be compromised.
“Early reports of reaction to
the new policy suggest that most commuters are willing to accept
the inconvenience of random searches if they are necessary to
improve transit security. I have complete faith in Police Commissioner
Kelly’s ability to conduct searches that helps ensure our
safety while not violating civil rights; however, some New Yorkers,
are uneasy about the possibility of abuse. The NYPD can answer
these concerns by guaranteeing that officers confine their searches
to materials relevant to terrorist activity and treat apprehensive
commuters with civility."
